2. The control also applies to drugs containing the means and substances specified in the present list, regardless of their number and the presence of neutral components (water, starch, sugar, sodium bicarbonate, talc, etc.). With regard to combined drugs containing, except for the main controlled substance, other pharmacologically active components, the control is established individually by incorporating this combined drug to the corresponding list of this list.

3. Transit through the territory of the Russian Federation of narcotic drugs, psychotropic substances and their precursors included in this list are prohibited.

The main law regulating supervision of the appearance of precursors of narcotic drugs and psychotropic substances is (hereinafter - the law on narcotic drugs and psychotropic substances). Under the precursors of narcotic drugs and psychotropic substances (hereinafter - precursors) means substances that are often used in production, manufacturing, processing included in the list of drugs, psychotropic substances and their precursors approved by the Decree of the Government of the Russian Federation of 06/30/1998 No. 681 (hereinafter - the list ), in accordance with international treaties of the Russian Federation, including the United Nations Convention on the Fight against the Unlawful Narcotic Drug Trafficking and Psychotropic Substances of 1988.

List of precursors of narcotic drugs and psychotropic substances

The list of precursors of narcotic drugs and psychotropic substances (hereinafter - precursors or precursors of the National Assembly and PV) to be controlled in the Russian Federation depending on the control measures used by the state are made to the following lists:

  • the list of precursors of the NA and PV, whose turnover in the Russian Federation is prohibited, with the exception of some cases (scientific purposes, operational-search activities, etc.) (hereinafter referred to as List I).
  • the list of ns and PV precursors, whose turnover in the Russian Federation is limited and for which control measures are established in accordance with the legislation of the Russian Federation and international treaties of the Russian Federation (hereinafter referred to as List IV), including:
    • table of precursors whose turnover in the Russian Federation is limited and for which special control measures are established (hereinafter - Table I);
    • table of precursors whose turnover in the Russian Federation is limited and for which general control measures are established (hereinafter - Table II);
    • the precursor table whose turnover in the Russian Federation is limited and for which the exclusion of certain control measures is allowed (hereinafter - Table III).

Medical organizations, when providing patients with medical services, often use medical products in their activities or drugs containing in their composition the list of the list of IV List, whose turnover in the Russian Federation is limited. The status of precursors to be state control, such products are purchased only if they contain any solutions, mixtures and alloys listed in the substances and if their concentration exceeds the norm set in the table, including salts of such substances if their existence is possible.

In relation to the precursors of the table I list IV, the state establishes the most stringent control measures, to the precursors of Table III are the most soft. These requirements are presented in a schematic table below the feature of the turnover of the list of the list I are not presented in this article, as the turnover of the precursors of this list is prohibited in the Russian Federation and is not used in medical and (or) pharmaceutical activities.

Control over the turnover of precursors listed in the list IV

In art. 30 of the Law on NA and PV established general provisions On control over the turnover of precursors listed in the list IV.

Below, the table presents measures to control the turnover of NA and PV precursors and PV included in List IV.

The concentration of the substances specified in the list of the IV of this List is determined on the basis of massword substances in the composition of the mixture (solution).

  • the name, address of the location of the applicant, carrying out import (export), OGRN, INN, the names and addresses of the locations of the manufacturer and the consignee, as well as the importer (in the case of export);
  • the name of the narcotic drug, the psychotropic substance or the precursor specified in the list, the name under which they are produced, the international non-proprietary name of a narcotic drug or psychotropic substance, if there is, or the first name under which it was issued;
  • drug form of narcotic drug, psychotropic substance or precursor;
  • the amount of narcotic drugs, psychotropic substances or precursors in a particular party;
  • dates of importance (export) substances;
  • a country from which (in which) imports (exportation) of narcotic drugs, psychotropic substances or precursors;
  • type of transport, which is supposed to be used for import (export) substances or method of sending them;
  • the estimated place and time of intersection of the state border of the Russian Federation of a particular part of narcotic drugs, psychotropic substances or precursors

To obtain a certificate, it is necessary to provide permission of the GND of the Ministry of Internal Affairs, as well as the certificate of quality of the drug.

The validity period of the certificate may not exceed 1 year from the date of its issuance and is limited to the action of the contract and other permittees.

If there is no substance in section 2.12, but it is in one of the lists from the Decree of the Government of the Russian Federation No. 681, then the license of the Ministry of Industry and Commission on this substance is not required, but the conclusion of the GND of the Ministry of Internal Affairs should be issued at it anyway.

Features of the license of the Ministry of Industry Drugs on narcotic drugs, psychotropic substances and their precursors

The only feature of the license of the Ministry of Industry to drugs, psychotropic substances and their precursors are as follows: it is necessary to take into account that permission is issued on substancesfalling under the control of the Ministry of Internal Affairs, and in the license of the Ministry of Industry imported products containing this substancewhy there may be misunderstanding and the question from customs about the inconsistency of these data and the percentage of substances. Examples of identifying documentation for import substances

Example 1.

The Russian company "A" plans to enter a batch of acetic acid with a concentration of 87%. Code TN VED 2915 21 000 0.

This company has no license to carry out activities on the turnover of narcotic drugs, psychotropic substances and their precursors.

1. We check in decision No. 30, namely in paragraph 2.12, the presence of acetic acid - the substance is indicated in Table III, paragraph 35, concentration - 80% or more. From this we conclude that the batch of acetic acid concentration of 87% is subject to licensing.

2. We check the presence of acetic acid in the Decree of the Government of the Russian Federation of June 30, 1998 No. 681 - the substance is specified in Table 3 of the IV list. The turnover of this substance is allowed to any legal entities, despite their organizational and legal form and the presence of a license for the circulation of narcotic drugs, psychotropic substances and their precursors.

Accordingly, the company "A" can enter this product, after providing permission from the MTD GNC and on its basis the license of the Ministry of Industry.

Example 2.

The same company decided to enter the polymer coating party, which contains a substance - Gammabutirolactone.

1. Check the presence of this substance in paragraph 2.12 - it is indicated in Table I under paragraph 279.1. In this regard, for the importation, it is necessary to issue a license to the Ministry of Industry.

2. We check the presence of gammabutyrolactone in the Decree of the Government of the Russian Federation of June 30, 1998 No. 681 - the substance is listed in the list III. The turnover of this substance in the territory of the Russian Federation is possible only if the company has a license to circulate narcotic drugs, psychotropic substances and their precursors, cultivation of drug-containing plants.

The company "A" has a similar license, respectively, it is prohibited by the import of this polymer coating, which contains gammabutyrolactone.
